Abstract

Information society, through the targeted use of collected information, tends to break down and fragment people with the constant production of partial profiles making them lose their wholeness. It becomes necessary to focus on the legislative gap regarding the handling of data and privacy protection, with special attention to so–called “sensitive” data according to the Law of 31 December 1996 n. 675, art. 22. The purpose of this paper is to highlight the various benefits of privacy by design policies in the full knowledge that only through a legislative provision that moves in this direction, we can achieve the expected results obviating the danger of compromising the fundamental rights of any person.
